Negotiated procedure

A negotiated procedure is a public tender in which the buyer may discuss terms with bidders rather than accept fixed submissions. It is permitted only in defined circumstances, such as a failed open procedure or a contract whose specification cannot be set in advance, and its use must usually be justified in the notice.
