Saudi Arabia's new procurement law: what changes for suppliers
Saudi Arabia's new Government Tenders and Procurement Law, issued by Royal Decree M/76 and published in Umm Al-Qura on 4 September 2026, takes effect 120 days after that publication (art. 101) and replaces the 2019 law, Royal Decree M/128 (art. 100). For a supplier the most visible change is direct purchase: the new law allows it up to an estimated cost of SAR 1,000,000 (art. 32), where the Ministry of Finance's table of amendments gives the old ceiling as SAR 100,000. Tenders put out under the 2019 law stay under it (Royal Decree M/76, item 3).
The official texts are in Arabic. Each passage on this page is the Arabic as Umm Al-Qura or the Ministry of Finance prints it, read on 11 October 2026, with TRINTA's translation under it.

The law, the decree and the dates
The Council of Ministers approved the law by Decision 199 of 21/02/1448 AH, and Royal Decree M/76 of 27/02/1448 AH issued it; the first item of both approves the Government Tenders and Procurement Law in the form attached to it. The Ministry of Finance published the minister's statement on the Council's approval on 22/02/1448 AH.
Umm Al-Qura, the official gazette, published the law on 4 September 2026, a day it also dates 22/03/1448 AH. Article 101 starts the clock there: the law takes effect once 120 days have passed from that publication. Article 100 makes it replace the law issued by Royal Decree M/128 of 13/11/1440 AH, the 2019 law, and repeal whatever conflicts with it.
The new law runs to 101 articles and leaves many details to its Implementing Regulation. Article 99 gives the Ministry of Finance, working with the Local Content and Government Procurement Authority, 120 days from publication to prepare it, and the Regulation applies from the day the law does. Article 98 has the Council of Ministers issue, in the same 120 days, the regulations it lists, the Preference Regulation among them.
Decision 199 also names the bodies the law calls competent for unified procurement: the General Authority for Military Industries for military and security procurement, and the Expenditure Efficiency and Government Projects Authority for all other government procurement (item 10). Items on the lists they keep are bought only through the framework agreements they conclude (art. 15).

What the text says to a foreign supplier
When a government entity deals with persons licensed outside the Kingdom for procurement or works inside it, article 3 has it make sure that no more than one person licensed inside the Kingdom is qualified for the job (para. 2); the Regulation sets the conditions and the special provisions (paras. 2 and 3). Works and procurement carried out outside the Kingdom follow special provisions the Regulation sets (art. 11).
A bid comes with an initial guarantee of 1% to 2% of its value (art. 41). Guarantees are accepted as a letter from a local bank, as a letter from a bank outside the Kingdom presented through a local bank, or in another form the Regulation sets (art. 61).
Contracts and their documents are drafted in Arabic; another language may sit beside it, but the Arabic governs interpretation, performance, specifications, drawings and correspondence (art. 52, para. 2). Entities funded from the state budget pay in Saudi riyals; another currency needs the Ministry of Finance's approval, or its silence for a period the Regulation sets, and is named in the tender documents (art. 62).
Contracts are made directly with those authorised to work, without intermediaries; a distributor or agent accredited by the original manufacturer, a franchise holder and those licensed to act as intermediaries are not intermediaries (art. 90).

Local content and preference
Priority goes to local small and medium enterprises, to local content and to companies listed on the financial market, by the mechanism of the Preference Regulation (art. 9). Entities coordinate with the Local Content and Government Procurement Authority on local content requirements when they plan their purchases (art. 12, para. 2), an obligation the Ministry of Finance lists as new.
The Preference Regulation must set how local content is preferred and calculated, including the preference percentage in the technical and financial evaluation of bids or the mandatory share of local content in the contract's value (art. 98, para. 2). The decree keeps the current regulations in force, the Preference Regulation of Council of Ministers Decision 245 among them (item 5), and Decision 199 asks the Ministry and the Authority to check them against the new law (item 5, para. 2).
The Authority may also contract for industrial localisation and knowledge transfer, under separate rules the Ministry issues with it (art. 34).

Etimad under the new law
The law calls it the Portal: a unified electronic portal for government procurement under the Ministry of Finance's supervision (art. 1). It does not use the name Etimad; the Ministry of Finance's FAQ on the 2019 law calls that law's portal the electronic portal, Etimad.
Procedures are put out through the Portal unless technical reasons or national security prevent it (art. 16). Public competition is announced on it (art. 29, para. 1), the tender documents are there in electronic form (art. 21, para. 2), and bids are submitted on it, encrypted (art. 36, para. 1).
The Ministry supervises the Portal and keeps developing it (art. 13, para. 1), and Decision 199 asks it to link the Portal technically with the Ministry of Justice, the Board of Grievances and other bodies, so that their decisions on the legal status of bidders and contractors reach it (item 11). The platform as it stands: Etimad.
عند حدوث عطل تقني في البوابة الإلكترونية (اعتماد)، يُمدد الإجراء المتعذر تنفيذه لمدة تماثل مدة التعطل.
TranslationWhen a technical failure occurs on the electronic portal (Etimad), the procedure that could not be carried out is extended by a period equal to the outage.

TranslationGovernment tender and procurement procedures are put out through the Portal (unless that is impossible for technical reasons or reasons of national security), as the Regulation sets out.
TranslationElectronic copies of the tender documents must be made available on the Portal; the Regulation sets the alternative means that may be used if that is impossible for technical reasons or reasons of national security.

Translation1. Coordinating with the Ministry of Justice, the Board of Grievances and the other relevant bodies to link the electronic portal of the Government Tenders and Procurement Law technically with those bodies, to ensure the Law is applied and its application is aligned with the decisions those bodies issue on the legal status of bidders and of contractors with government entities. [The first task item 11 gives the Ministry of Finance.]
What carries over
Until the new law takes effect it is the 2019 law that applies, and tenders put out under it stay under it afterwards (item 3). Exceptions already granted continue (item 4), and so do the regulations issued under the 2019 law: the Preference Regulation and the regulations on conflicts of interest and on the conduct of those applying the law, Council of Ministers Decisions 245 and 537 (item 5).
Public competition remains the rule. The Ministry of Finance's FAQ on the 2019 law says so of that law, and article 28 of the new law says it again: all works and procurement are put out to public competition, except what the law exempts. And the procedures run through the Portal (art. 16), as they ran under the 2019 law through the portal the Ministry's FAQ calls Etimad.
الأصل هو أن تطرح جميع الأعمال والمشتريات في منافسة عامة، عدا ما يستثنى منها بموجب أحكام النظام ولائحته التنفيذية.
TranslationThe rule is that all works and procurement are put out to public competition, except what is exempted under the provisions of the Law and its Implementing Regulation.

Frequently asked questions
01
When does Saudi Arabia's new procurement law take effect?
+
120 days after its publication in the Official Gazette (art. 101). Umm Al-Qura published it on 4 September 2026 (22/03/1448 AH). It then replaces the 2019 law, Royal Decree M/128 (art. 100), and tenders put out under the 2019 law stay under it (Royal Decree M/76, item 3).
02
What is the number of Saudi Arabia's new Government Tenders and Procurement Law?
+
Royal Decree M/76 of 27/02/1448 AH issued it, on Council of Ministers Decision 199 of 21/02/1448 AH. It replaces the law of Royal Decree M/128 of 13/11/1440 AH.
03
What is the direct purchase limit in Saudi Arabia under the new law?
+
An estimated cost of up to SAR 1,000,000, with priority to local small and medium enterprises (art. 32, para. 3). The Ministry of Finance gives the old ceiling as SAR 100,000. The entity must state and document its reasons (art. 32).
04
Does the new law apply to tenders already published on Etimad?
+
Works and procurement put out while the 2019 law was in force stay under the 2019 law. By way of exception, the Minister of Finance may apply some provisions of the new law to them under a mechanism he sets (Royal Decree M/76, item 3).
05
Are Saudi government tenders still on Etimad under the new law?
+
The law keeps the procedures on the Portal, a unified electronic portal under the Ministry of Finance (arts. 1 and 16): public competition is announced there and bids are submitted there, encrypted (arts. 29 and 36). The law does not name it; the Ministry of Finance's FAQ on the 2019 law calls that law's portal Etimad.
06
How much can a Saudi government contract change under the new law?
+
New items up to 10% of the contract or purchase order with the contractor's consent, existing items up 20% (consent for the increase beyond 10%) or down 20% (more with consent), and no more than 20% in total increase (art. 67).
07
Can a foreign company bid under the new Saudi procurement law?
+
The law provides for dealing with persons licensed outside the Kingdom: the entity makes sure that no more than one person licensed inside the Kingdom is qualified, and the Regulation sets the conditions (art. 3). Contracts are in Arabic (art. 52), guarantees come from a local bank or through one (art. 61), and payment is in riyals unless the Ministry agrees otherwise (art. 62).
08
What does the new Saudi law say about local content?
+
Priority goes to local small and medium enterprises, local content and listed companies, through the Preference Regulation (art. 9), which must set the preference percentage in evaluation or the mandatory share of local content (art. 98). Entities coordinate with the Local Content and Government Procurement Authority when planning (art. 12), and the current Preference Regulation stays in force (Royal Decree M/76, item 5).
