Whoever bids in a public or limited tender, a practice or a direct contract: article 31 of the public tenders law requires the bidder to be registered in the register of suppliers or contractors, as the procurement requires. 1. Prepare the documents CAPT lists for a foreign company, the authorised signatories and the company's commercial licence among them, approved and certified by the Embassy of the State of Kuwait in the country of the head office. 2. Upload them through CAPT's foreign company registration as colour copies in Arabic and English, in PDF; a request with a missing document does not go through. 3. When CAPT finds the application complete, it emails a link to pay the registration fee, KWD 100 including one authorised signature. 4. Once CAPT's Board of Directors approves the registration, the company's registration certificate arrives by email; CAPT gives the process as a week to 10 days. 5. Buy the tender on CAPT's tenders pages: only logged-in companies can purchase tenders. Checked on 12 Oct 2026 against the official sources linked above. Public tenders are governed by Law No. (49) of 2016 on public tenders, as amended by Law No. (74) of 2019; CAPT publishes it in English and says the Arabic version governs where the two differ. Decree-Law No. 94 of 2026, published in Kuwait Al-Youm, the official gazette, on 27 September 2026, replaces several articles of that law and takes effect three months after its publication; its new articles do not apply to procurement announced before it takes effect, except articles 62 and 62 bis.

The 2026 text of article 31 bans the use of a local agent or a commission agent in every contracting procedure, under rules the Council of Ministers sets, and lifts the commercial register condition for a foreign bidder under rules the executive regulation sets. Decree-Law No. 94 of 2026, published in Kuwait Al-Youm, the official gazette, on 27 September 2026, replaces several articles of that law and takes effect three months after its publication; its new articles do not apply to procurement announced before it takes effect, except articles 62 and 62 bis.

Every bid carries an initial guarantee: a certified cheque or a guarantee letter from a bank authorised in Kuwait, in favour of CAPT and without conditions, valid for the bid's validity; a bid without it is not considered (law, article 45). The executive regulation, as CAPT publishes it, has the procuring body set it at no less than 1% and no more than 5% of the tender's total estimated value (article 30).

The 2026 text lets a public body contract without CAPT's permission when the contract does not exceed KWD 1,000,000 (article 19).

The 2026 text has the Council of Ministers name the minister or public body that regulates which products get priority in public purchasing (article 62). The 2026 text awards to SME bids that meet the specifications and are priced no more than 10% above the lowest acceptable bid; that priority cannot be combined with the product priority of article 62 in the same tender (article 62 bis). The 2026 text of article 87 has foreign and local contractors buy at least 30% of the products listed in the industrial guide of the Public Authority for Industry, and a foreign contractor assign at least 30% of the works to local contractors registered with CAPT, 10% of it to SMEs.

Tenders are announced in the Official Gazette, in Arabic and at least one foreign language for external tenders, and on the website (law, article 14). The invitation is published in the Official Gazette and on CAPT's website at least 30 days before the deadline (law, article 38).
